User Agreement

WingLedger is a cloud-based aviation record management platform.

Depending on the features you use, WingLedger may allow you to:

• record flights;

• maintain a digital pilot logbook;

• store aircraft information;

• upload maintenance documents;

• request digital endorsements;

• record instructor or examiner approvals;

• share aircraft information with syndicate members;

• upload photographs and supporting documents;

• export your aviation records.

WingLedger is continually evolving, so features may change over time.

Some features may only be available on certain subscription plans.

WingLedger is designed to help you organise aviation records.

It is not:

• an aviation authority;

• a flight school;

• an instructor;

• an examiner;

• an aircraft maintenance organisation;

• an engineering authority;

• an insurance provider;

• a legal adviser.

Using WingLedger does not replace your responsibility to comply with the regulations that apply to your flying.

Throughout this Agreement, we've used a few words consistently.

Account means your registered WingLedger account.

Agreement means this User Agreement.

Content means anything you create, upload or record using WingLedger.

This includes:

• flight records;

• endorsements;

• maintenance records;

• documents;

• photographs;

• notes;

• aircraft information;

• profile information.

Endorsement means any approval, signature, verification or confirmation recorded within WingLedger.

Shared Aircraft means any aircraft whose information is shared with more than one authorised user.

Syndicate means a group of WingLedger users sharing information relating to one or more aircraft.

Subscription means any paid service offered by WingLedger.

We, our and us refer to WingLedger.

You refers to the person using the service.

WingLedger is intended for pilots and aviation enthusiasts around the world.

You may create an account provided you are legally permitted to do so in the country where you live.

If you're below the minimum age required to create an online account where you live, a parent or legal guardian must provide any consent required by law.

You don't need to hold a pilot licence to use WingLedger.

Student pilots are welcome.

Likewise, instructors, examiners, aircraft owners, syndicate members and aviation organisations may all use WingLedger where appropriate.

When you register with WingLedger you agree to provide information that is accurate and up to date.

You agree not to:

• create an account using false information;

• impersonate another person;

• create accounts for unlawful purposes;

• attempt to bypass restrictions placed on your account.

If any of your account information changes, you should update it as soon as reasonably possible.

Some features may require additional verification before they become available.

Your account is personal to you.

You're responsible for keeping your login details confidential.

Please choose a strong password and avoid sharing it with other people.

If you believe someone has accessed your account without your permission, you should:

• change your password immediately;

• revoke active sessions where possible;

• contact WingLedger if you believe your account has been compromised.

We'll never ask you for your password by email.

WingLedger is built around one simple principle:

You remain responsible for your flying records.

We'll provide the tools.

You'll remain responsible for the information entered into those tools.

You agree that information recorded within WingLedger will, to the best of your knowledge, be:

• truthful;

• accurate;

• complete;

• recorded in good faith.

You should correct mistakes as soon as you become aware of them.

WingLedger helps organise aviation information.

It doesn't make aviation decisions.

You remain solely responsible for ensuring that:

• your logbook is accurate;

• flights are recorded correctly;

• your licence remains valid;

• ratings remain current;

• certificates remain current;

• medical information is accurate;

• recency requirements are met;

• aircraft maintenance records are complete;

• mandatory inspections are carried out;

• defects are managed appropriately;

• your aircraft remains airworthy where applicable;

• your insurance remains valid;

• you comply with the rules of the aviation authority responsible for your flying.

Nothing within WingLedger should be interpreted as aviation advice.

Everything you create within WingLedger belongs to you.

That includes:

• your flights;

• your notes;

• your photographs;

• your uploaded files;

• maintenance documents;

• endorsements;

• aircraft records you've created.

We don't claim ownership of your aviation history.

By using WingLedger, you give us permission to:

• securely store your information;

• process it;

• display it;

• back it up;

• synchronise it across your devices;

• generate exports you've requested.

We'll only use your personal information as described in our Privacy Policy.

We believe your aviation history should never become trapped inside one platform.

You may export your information whenever export facilities are available.

Before permanently deleting your account, you'll also be given the opportunity to download your information.

We'll aim to make exported information compatible with widely used formats.

However, because aviation authorities around the world have different requirements, we cannot guarantee that every exported document will be accepted without additional review or supporting evidence.

Some WingLedger features allow you to share information with other people.

Examples include:

• requesting endorsements;

• sharing aircraft information;

• syndicate management;

• collaborative maintenance records.

You remain responsible for deciding what information you choose to share.

People you've shared information with may be able to view, comment on or update that information depending on the permissions you've granted.

You should only share information with people you trust.

WingLedger allows you to request digital endorsements from instructors, examiners and other authorised individuals.

When someone completes an endorsement, WingLedger records the information they've provided together with supporting metadata, such as the date and time it was completed.

An endorsement may include:

• the endorser's name;

• licence or reference number;

• comments;

• a digital signature;

• supporting notes.

WingLedger records this information but does not independently verify:

• the identity of the person providing the endorsement;

• their qualifications;

• their authority to endorse the record;

• the accuracy of the information they've entered.

It remains your responsibility to ensure endorsements are obtained from appropriately qualified people and satisfy the requirements of the relevant aviation authority.

Digital signatures recorded within WingLedger are intended to help preserve the integrity of your aviation records.

WingLedger stores signature images and associated audit information as part of your record.

We take reasonable steps to help protect these records from unauthorised alteration.

However, WingLedger does not certify or guarantee the legal validity of any signature in every jurisdiction.

The legal recognition of electronic signatures varies around the world.

It remains your responsibility to ensure that electronic signatures are acceptable for the purpose for which they are being used.

WingLedger allows multiple authorised users to work together when managing an aircraft.

Depending on the permissions granted, syndicate members may be able to:

• record flights;

• upload maintenance records;

• report defects;

• update aircraft information;

• record expenses;

• view shared documentation.

The syndicate administrator controls membership and permissions.

WingLedger does not verify ownership of aircraft or resolve disagreements between syndicate members.

Operational decisions, maintenance decisions, financial arrangements and ownership disputes remain entirely the responsibility of the individuals involved.

WingLedger allows you to upload a variety of information to help manage your aviation records.

This may include:

• photographs;

• licences;

• maintenance documents;

• inspection reports;

• aircraft paperwork;

• checklists;

• manuals;

• certificates;

• other supporting files.

You remain responsible for everything you upload.

By uploading content, you confirm that:

• you own it or have permission to upload it;

• it does not infringe another person's copyright or intellectual property;

• it does not contain malicious software;

• it is not unlawful;

• it is not deliberately misleading or fraudulent.

If we reasonably believe uploaded content breaches this Agreement, we may remove it or temporarily restrict access to it while we investigate.

Different subscription plans include different storage allowances.

Your current storage allowance is displayed within WingLedger or on our pricing page.

If you reach your storage limit, you may:

• delete files;

• purchase additional storage where available;

• upgrade your subscription.

We won't automatically delete your existing files simply because you've reached your allowance.

However, additional uploads may be prevented until sufficient storage becomes available.

Storage limits may change as WingLedger evolves.

Where practical, we'll provide reasonable notice before changes that significantly reduce available storage.

We believe everyone should be able to try WingLedger before deciding whether it's right for them.

Free accounts provide access to the core service but may include limits on:

• flight records;

• storage;

• exports;

• features;

• integrations;

• other functionality.

Current limits are published on our website and may change over time.

Some WingLedger features require an active subscription.

Subscription options, pricing and billing frequency are displayed before purchase.

When you subscribe, you're authorising the payment provider to collect the subscription charges you've agreed to.

Subscriptions renew automatically unless cancelled before the renewal date.

We'll always try to make pricing clear before you commit.

Payments are processed by trusted third-party payment providers.

WingLedger doesn't store your full payment card details.

If a payment cannot be collected, we may:

• retry the payment;

• notify you;

• temporarily suspend subscription features;

• return your account to the free plan.

If you believe you've been charged incorrectly, please contact us as soon as possible.

We'll always investigate fairly.

Nothing in this Agreement affects any refund rights that apply under the consumer laws applicable to you.

If your subscription ends, your account may automatically move to the free plan.

We'll never deliberately delete your flight records simply because your subscription has ended.

However, if your account exceeds the limits of the free plan, you may be unable to:

• add additional flights;

• upload further documents;

• access subscription-only features.

Existing information will remain available unless otherwise explained.

WingLedger is an online service.

Although we work hard to keep it available, occasional interruptions are unavoidable.

Examples include:

• planned maintenance;

• security updates;

• software releases;

• failures affecting cloud providers;

• internet outages;

• events beyond our reasonable control.

We'll always try to minimise disruption.

Where practical, planned maintenance will be announced in advance.

WingLedger will continue evolving.

From time to time we'll introduce:

• new features;

• bug fixes;

• performance improvements;

• security enhancements;

• interface improvements.

Some updates may change how existing features behave.

Where significant changes affect the way you use WingLedger, we'll try to let you know beforehand.

To help protect WingLedger and everyone who uses it, you agree not to:

• break the law;

• interfere with the operation of WingLedger;

• attempt to access another person's account;

• upload malware;

• deliberately upload false or misleading information;

• misuse endorsement features;

• harvest user information;

• attempt to bypass security measures;

• reverse engineer the platform except where permitted by law;

• use automated systems to scrape or overload the service;

• impersonate another person or organisation.

You also agree not to use WingLedger in any way that could reasonably damage the reputation or security of the platform.

Endorsements are intended to represent genuine aviation approvals.

You must not:

• create false endorsements;

• request endorsements you know to be misleading;

• impersonate instructors or examiners;

• attempt to manipulate endorsement records.

Where we reasonably believe endorsement fraud has occurred, we may suspend or permanently close the accounts involved.

WingLedger owns all intellectual property relating to the platform itself.

This includes:

• software;

• branding;

• logos;

• icons;

• graphics;

• interface design;

• documentation;

• source code.

Nothing in this Agreement transfers ownership of WingLedger's intellectual property to you.

However...

Everything you create remains yours.

That includes:

• your logbook;

• photographs;

• uploaded documents;

• maintenance records;

• notes;

• aircraft information you've entered.

We're simply storing and processing it on your behalf.

WingLedger relies on trusted third-party providers to operate parts of the platform.

These may include providers for:

• hosting;

• authentication;

• cloud storage;

• payment processing;

• email delivery;

• monitoring;

• backups.

We carefully choose providers that meet appropriate security and privacy standards.

However, because these services are operated independently, we cannot guarantee their uninterrupted availability.

Where a third-party provider experiences an outage, some WingLedger features may also become temporarily unavailable.

Our current data processors are listed in our Privacy Policy.

Occasionally we may make experimental features available before they're fully released.

Beta features help us improve WingLedger through real-world feedback.

Because they're still under development, beta features may:

·         change without notice;

·         contain bugs;

·         be withdrawn;

·         operate differently from the final version.

You're never required to use a beta feature.

Feedback you provide helps improve WingLedger for everyone.

WingLedger may calculate totals, flight currency, licence validity, medical expiry dates, aircraft utilisation, maintenance intervals and other aviation-related information based on the information you provide.

These calculations are designed to help you manage your aviation records more effectively.

However, they are provided for informational purposes only.

You should always verify important dates, calculations and requirements against your own records and the regulations that apply to your flying.

If the information entered into WingLedger is incomplete, inaccurate or out of date, any calculations or reminders generated by WingLedger may also be incomplete or inaccurate.

You should never rely solely on WingLedger when deciding whether you are legally permitted or medically fit to undertake a flight.

Aviation authorities around the world have different requirements for logbooks, endorsements and supporting documentation.

WingLedger has been designed to produce organised, exportable aviation records.

However, we cannot guarantee that:

• a regulator;

• an examiner;

• an instructor;

• a flying school;

• an insurance company; or

• any other organisation

will accept records exported from WingLedger.

Acceptance of any record always remains the decision of the organisation receiving it.

Where additional evidence is required, you remain responsible for providing it.

We take our responsibilities seriously.

We'll take reasonable care to:

• protect your information;

• operate WingLedger responsibly;

• maintain the integrity of your data;

• improve the platform over time;

• investigate genuine security concerns;

• provide support where reasonably possible.

Although we aim to provide a dependable service, no online platform can promise uninterrupted operation or guarantee that every defect will be corrected immediately.

WingLedger helps organise aviation records.

It does not replace your own responsibilities as a pilot, aircraft owner, syndicate member, instructor, examiner or operator.

You remain solely responsible for:

• your flying decisions;

• aircraft operation;

• airworthiness;

• maintenance;

• licensing;

• ratings;

• medical certification;

• insurance;

• regulatory compliance;

• operational safety.

Nothing within WingLedger should be interpreted as operational, engineering, legal or aviation advice.

Nothing in this Agreement excludes or limits liability where doing so would be unlawful.

Subject to that, WingLedger will not be responsible for loss or damage arising from:

• inaccurate information entered by users;

• decisions made using information stored within WingLedger;

• missed licence renewals;

• expired ratings or certificates;

• expired medical certificates;

• aircraft maintenance decisions;

• engineering decisions;

• operational decisions;

• insurance decisions;

• regulatory action;

• the temporary unavailability of WingLedger;

• failures affecting third-party providers;

• events beyond our reasonable control.

Where the law permits, WingLedger's total liability arising from your use of the service will not exceed the total amount you have paid to us during the twelve months immediately preceding the event giving rise to the claim.

Nothing in this Agreement affects any statutory rights you have as a consumer.

Sometimes circumstances occur that are beyond anybody's reasonable control.

Examples include:

• severe weather;

• natural disasters;

• fire;

• flooding;

• widespread internet failures;

• power outages;

• cyber attacks;

• government action;

• industrial disputes;

• armed conflict;

• failures affecting critical infrastructure.

Where these events prevent WingLedger from operating normally, we won't be responsible for delays or interruptions directly resulting from those circumstances.

We'll always work to restore normal service as quickly as reasonably possible.

You're free to close your WingLedger account whenever you choose.

Before your account is permanently deleted, we'll provide the opportunity to download your aviation records where that functionality is available.

Deleting your account permanently removes your access to WingLedger.

Some information may continue to be retained for a limited period where required:

• by law;

• to prevent fraud;

• to resolve disputes;

• to protect the security of the platform;

• to comply with our legal obligations.

Further information about data retention is available in our Privacy Policy.

We hope we'll never need to.

However, we may suspend or permanently close an account where we reasonably believe:

• this Agreement has been seriously breached;

• unlawful activity has occurred;

• another user's safety, privacy or rights are at risk;

• fraudulent activity has taken place;

• WingLedger's security has been compromised.

Where practical, we'll explain why action has been taken and provide an opportunity to resolve the issue before permanently closing your account.

Some situations, particularly those involving security or unlawful activity, may require immediate action without prior notice.

WingLedger will continue evolving.

As new features, technologies and legal requirements emerge, we may update this Agreement.

Examples include:

• new products;

• new subscription plans;

• changes in legislation;

• improvements to security;

• new integrations.

Where we make significant changes, we'll notify you through WingLedger, by email or both.

The latest version will always be available on our website.

Your continued use of WingLedger after changes take effect means you accept the updated Agreement.

If you don't agree with the changes, you may stop using the service and close your account.

We'll always aim to respond within a reasonable time.

This Agreement is governed by the laws of Scotland.

Any dispute relating to this Agreement will normally be dealt with by the Scottish courts.

However, if the consumer protection laws that apply where you live provide you with additional rights or protections, nothing in this Agreement removes those rights where they apply.

If any part of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will continue to apply.

If we choose not to enforce part of this Agreement immediately, that doesn't mean we've waived our right to enforce it in the future.

This Agreement, together with our Privacy Policy and any other policies specifically referred to within it, forms the complete agreement between you and WingLedger regarding your use of the service.
